2 Idiots of the Week: Both GOP Politicians in FLORIDA!

Welcome back to Idiot of the Week! Since there are so many of them we had to feature 2 today. One for sexual harassment against several women, and the other for spending a LOT of Florida TAXPAYER money so he can live the high life.
Be aware of these fools, so you can vote the 2nd one OUT next election. The first one fortunately resigned.

IDIOT #1 -  State Sen. Jack Latvala quits in face of corruption investigation, possible expulsion
State Sen. Jack Latvala quits
Facing a public corruption investigation and possible expulsion from the Florida Senate, Jack Latvala resigned Wednesday, a day after a retired judge concluded that he likely violated state corruption laws by trading legislative favors for physical contact and for sexually harassing and groping multiple women.

Latvala, 66, of Clearwater, a longtime Tampa Bay leader and Republican candidate for governor, sent a letter of resignation to Senate President Joe Negron in an abrupt and dramatic end to a controversial career that spanned three decades. Latvala’s resignation, effective at midnight Jan. 5,  2018 followed a revelation in retired Judge Ronald Swanson’s 33-page report, reportedly documented by explicit text messages from the senator over the past three years, that he agreed to support a lobbyist’s agenda if she would have sex with him or let him touch her in a sexual manner.

IDIOT #2 -  FLORIDA HOUSE SPEAKER RICHARD CORCORAN’S BIG
GOP Florida House Speaker Richard Corcoran
SPENDING

GOP Florida House Speaker Richard Corcoran lives the high life. He’s raising big money for the state Republican Party and his political committee, and the cash is being spent on junkets to Napa Valley, charter planes and steak dinners. Lots of steak dinners.
A review of the Republican Party of Florida’s finances by Tampa Bay Times reveals how money largely raised from special interests fuels Corcoran’s high-priced political operation. There’s an $8,000 dinner tab at California’s French Laundry restaurant, more than $400,000 for charter planes, more than $26,000 at steakhouses such as Morton’s and Ruth’s Chris — and $1,000 for cufflinks. Corcoran’s primary political operative has been reimbursed more than $1.5 million for party expenses billed to his credit card. Corcoran remains remarkably unrepentant. http://www.miamiherald.com/opinion/editorials/article190692764.html#emlnl=Morning_Newsletter#storylink=cpy

SIDE NOTE ABOUT CORCORAN- He's Driving Elected Officials of his own party OUT:
This year, nine Republican members of the Florida House of Representatives eligible for reelection have either left the House or plan to run for another office.
Several have cited conflicts with House Speaker Richard Corcoran, objecting to what they call his dictatorial leadership style. Some say that relationship with Corcoran factored in their decisions to leave.
Several of the departing legislators were among those who voted against top Corcoran priorities in the 2017 legislative session, including a bill to allow liquor sales in grocery stores and another to slash business recruiting and tourism promotions programs.

Idiot of the Week: Missouri State Congressman Claims Gay People Are "not human"

Believe it or not, there is an American congressman who genuinely does not understand the definition of human being. He basically thinks gay people are "not human."
How do these fools get elected?
We wouldn't be surprised if he was another closeted Republican who gay bashes to throw off his constituents.
WAIT! There's MORE! He's even wackier than that:
Rick Brattin, Who Wants Anti-Evolution Lessons In Missouri Schools: "I'm A Science Enthusiast" .https://www.riverfronttimes.com/newsblog/2013/02/07/rick-brattin-who-wants-anti-evolution-lessons-in-missouri-schools-im-a-science-enthusiast

Here's the original story:

Missouri state Representative Rick Brattin, revealed that he believed "there is a "distinction" between human beings and people who are gay" during a debate over a bill protecting the state's LGBTQ community from discrimination.

Missouri state Representative Rick Brattin
In Missouri, citizens can legally be discriminated against based on their sexual orientation. On May 8, state legislators attempted to pass an amendment banning sexual-orientation-based prejudice when Brattin expressed his concern over the proposal.

"When you look at the tenets of religion, of the Bible, of the Quran, of other religions, there is a distinction between homosexuality and just being a human being," Brattin told the House floor. According to The Kansas City Star , Brattin has yet to clarify his statement, although it aligns with his previous push for teaching creationism in public schools.

Idiots in Politics: Republicans Remove retirement savings programs for low-income workers

Here's another example of what a Republican controlled U.S. Government does to hurt people- and especially the low-income workers who voted them all into Congress and the White House.  NOW: Republicans Have Voted to remove retirement savings programs for low-income workers.   The Republican Party only cares about the wealthy. This is outrageous.

Congress rejects Labor Dept. rule for state retirement plans

Source: CBS News 5-4-17
Congress has narrowly voted to overturn an Obama-era rule designed to guide states as they create retirement savings programs for low-income workers.
The Republican-led Senate voted 50-49 Wednesday to reject the Labor Department rule, sending the measure to President Donald Trump.
With an estimated 55 million Americans lacking access to retirement savings plans at their jobs, some Democratic-leaning states have been working to fill the void.  (EDITOR'S NOTE: Democrats have been fighting to help low-income people get access to retirement savings, but they're not in control of the government)
At least seven states have launched programs requiring employers to automatically enroll workers in state-sponsored individual retirement accounts managed by investment professionals. The Obama administration gave states the green light last year.
But congressional Republicans said the state programs discourage small businesses from offering private retirement plans and have inadequate safeguards. While the state-run plans "might not seem too bad on the surface, what they really add up to is more government at the expense of the private sector and American workers," said Senate Majority Leader Mitch McConnell, R-Ky. (EDITOR'S NOTE: When are people in Kentucky going to Vote out McConnell, who doesn't care for them?)
The state plans would be exempt from federal protections that apply to private plans and would have a competitive advantage over private plans, McConnell said. If the repeal measure is signed, states still will be able to set up retirement plans but must follow federal laws that protect the workers' investments, McConnell said.

Two Republicans, Sens. Bob Corker of Tennessee and Todd Young of Indiana, joined Democrats in opposing the repeal measure.

The Senate voted to overturn the rule using the Congressional Review Act, a law that allows a simple majority in the House and Senate to overturn executive-branch regulations that lawmakers consider onerous or burdensome. Trump and congressional Republicans have overturned more than a dozen Obama-era regulations since Trump took office.
Democrats said the GOP measure would jeopardize efforts by states to help low-income workers.
States that have begun offering the plans include Illinois, California, Connecticut, New Jersey, Maryland, Oregon and Washington
Americans are not "clamoring" for Congress to take away their ability to save for retirement if their company doesn't offer a plan, said Senate Minority Leader Chuck Schumer, D-N.Y.
Instead, Wall Street financial firms that manage retirement plans "don't want to see any competition from city or state retirement plans," Schumer said.
He called the GOP legislation "another giveaway to the wealthy special interests" that will hurt working Americans who need have more low-cost choices for their retirement.
In Illinois, a new state program called Secure Choice will give 1.3 million residents the opportunity to save for retirement — "a pragmatic solution to address a real world problem" that now is at risk, said Sen. Tammy Duckworth, D-Ill.
"Instead of encouraging greater competition that will help 55 million Americans save money for retirement, some of my colleagues appear to be listening to Wall Street lobbyists who want less competition and who want to take away a retirement savings option from people," Duckworth said.
California state Senate President Pro Tempore Kevin de Leon vowed that his state will continue its retirement program.
"We will place the future and well-being of our workers over Wall Street greed," he said, promising that "Californians who have worked hard all their lives can retire at a reasonable age with a measure of dignity."

Idiots in Politics: GOP candidate's husband shares image urging voters to 'free the black slaves from the Democratic plantation'

This is what "Stupid" looks like
Here's this week's Idiot in Politics. This from a Georgia Republican running for Congress in June's election. Just appalling.

GOP candidate's husband shares image urging voters to 'free the black slaves from the Democratic plantation'

SOURCE: http://www.cnn.com/2017/05/02/politics/kfile-karen-handel-husband-tweet/index.html

(CNN)The husband of Republican congressional candidate Karen Handel shared an image on his Twitter timeline Tuesday that urged voters to support his wife in order to "free the black slaves from the Democratic plantation."
Handel's husband, Steve Handel, shared the image in the form of a quote-tweet, in which he shared the tweet of another user who initially posted the image and added his own commentary. In a statement to CNN's KFile on Tuesday, Handel's campaign said her husband hadn't paid attention to what was said in the original tweet.
"Like many of us, he (Steve) made a mistake and retweeted something he didn't pay a lot of attention to, thinking it was just an absentee vote message. It clearly was not appropriate and has been deleted," a campaign spokesperson said.
Handel is running to replace former Rep. Tom Price, who resigned his seat to become Health and Human Services Secretary. She's locked in a tight race in the runoff election with Democratic candidate Jon Ossoff.
The image, shared by user @rose10052, featured a stock image of young black man in a suit with white text.
"Criticizing black kids for obeying the law, studying in school, and being ambitious as 'acting white' is a trick Democrats play on Black people to keep them poor, ignorant, and dependent," text on the image reads. "Free the black slaves from the Democratic plantation."
"Handel will fight for minorities to excel," the image reads in bold letters at the top. The bottom of the image also tells people to "join the movement" to "send Karen Handel to Congress" with a link to her website.

Idiots in Politics: U.S. House passed a bill that affects overtime pay (and removes it)

Do you rely on Overtime to pay your bills or save money in a bank? It may be the end of it.  Did you know? On U.S. House passed a bill that affects overtime pay. Basically, it REMOVES overtime pay and substitutes it with time off at Regular pay.  HOW does this HELP people???

Do you get paid for overtime work? The House of Representatives just passed a bill you may want to know about.

CNN MONEY:  Source: http://money.cnn.com/2017/05/02/news/economy/overtime-pay-bill-passes-house/index.html?sr=twCNN050317overtime-pay-bill-passes-house0306PMVODtopLink&linkId=37149295

The measure, backed by Republicans, would let employers give workers paid time off instead of time-and-a-half pay the next time they put in extra hours. The vote tally was largely along party lines, with no Democrats voting in favor of the bill. Six Republicans also voted against it.

G.O.P. leadership has touted the legislation, called the Working Families Flexibility Act, as an attempt to codify flexibility for employees.  "I don't think there's anything more powerful than giving them more control over their time so that they can make the best decisions for themselves and their families," Rep. Cathy McMorris Rodgers of Washington said Tuesday morning in a press conference held by Republican leaders in the House.

The Trump administration also came out in support of the measure on Tuesday, May 2, 2017. The White House said in a news release that the president's advisers would recommend Trump sign the bill into law if it was presented to him in its current form.

But Democrats stand in strong opposition. Their chief concern is that employers have the final say on when comp time can be used, which means bosses can defer compensating employees for overtime work.

Sen. Elizabeth Warren of Massachusetts -- a Democrat who has made workers' protections her flagship cause and sits on the Senate Committee on Health, Education, Labor and Pensions -- called the bill a "disgrace" on Twitter.

Republicans, who hold 52 seats in the upper chamber, will need eight Democrats to vote in favor of the legislation to avoid a filibuster. The House bill is sponsored by Rep. Martha Roby of Alabama. Sen. Mike Lee of Utah has introduced a similar bill in the Senate, but it's still in committee.

Idiots in Politics: Trump Administration's "Blue Star" Cancellation

If you use an appliance, you likely have seen a "Blue Star" label on it. That means that the technology was improved to reduce pollution. It also means your appliance uses less energy and costs you less to operate. People and companies who use the technology benefit.
Except that the Trump Administration thinks saving Energy and reducing pollution is apparently stupid. So they're pulling the $60 million of funding from the program, killing it. How incredibly STUPID.

Here's the article from the Baltimore Sun:

White House targets Blue Star
Planned ax for energy saving push elicits mass shock

By Evan Halper, Baltimore Sun Washington Bureau

BOTTOM LINE: The Trump Administration is now planning to eliminate a voluntary, cost-effective initiative that has saved its customers millions of dollars and had almost no critics.

The Trump administration has decided the immensely popular Energy Star program must go.

The fight centers on the Environmental Protection Agency’s 25-year-old effort to boost efficiency in products and services by encouraging companies to compete for coveted, government-issued labels that certify a product or property meets high standards for saving energy and costs.

Functioning like a government seal of approval, the Energy Star program costs taxpayers a pittance and is widely beloved by the 16,000 companies and organizations that participate. Now it is fast becoming a test case of how committed the Trump administration is to pursuing the agenda of once-fringe groups seeking to slash government programs wherever they can.

“Never in my wildest thoughts have I considered something like this,” said Dave Pogue, who leads the sustainability efforts at Commercial Real Estate Company CBRE. He said the program helped the firm cut energy use at its properties by 16 percent in the last decade.

In the Trump administration Energy Star has come under scrutiny. The plan to jettison the program from the federal government, now embedded in the White House budget blueprint, emerged after Trump placed Myron Ebell, a prominent climate skeptic, in charge of his EPA transition team.

THE SOUNDS OF STUPID- Yes, the new head of the EPA REALLY Said This:
“The EPA is meant to improve environmental quality,” said Ebell. “I’m not sure what that has to do with how much energy consumers use. But a great deal of the work at EPA has been dedicated to that. The president made clear during the campaign he will get rid of as much of that as he possibly can.”

Energy Star has everything to with environmental quality - The nation’s biggest companies compete aggressively to win Energy Star labels for their products, which signal to consumers that everything from the air conditioners they purchase at Best Buy to the buildings where they lease office space engage advanced technologies to use the least possible amount of power. The eagerness to meet consumer demand for that seal of approval has driven firms to invest big in cutting energy use.

Energy Star has been a pillar of the federal government’s effort to fight climate change, with the EPA boasting that it has kept some 2.8 billion tons of greenhouse gas from escaping into the atmosphere — or roughly the equivalent produced from powering 36 million homes with electricity each year. It has enabled consumers and businesses to cut their energy bills more than $30 billion per year.

WHAT DOES IT COST?
At an annual cost of $60 million to taxpayers, it is easily the cheapest and least burdensome initiative the federal government runs to help Americans lower their energy consumption.

EVEN REPUBLICANS THINK ITS STUPID TO ELIMINATE IT
The proposal has been met with shock across party lines. Christie Todd Whitman, who ran the EPA during the administration of George W. Bush said, “not in a million years” would she have targeted Energy Star. “There was no reason to,” she said. “It was a no-brainer. It worked, and it hardly cost any money.”

This Week's Idiot in Politics: Alabama Gov. Robert Bentley Resigns Over Sex Scandal

The Alabama Governor ... Mug Shot
Here's the latest Idiot of the Week in Politics: Alabama Gov. Robert Bentley.
This is yet another hypocrite who calls himself a "Conservative Christian" (READ: Right wing Christian, not mainstream), and who has pushed "Family Values" and hatred and intolerance against gay people.  Alabama Christians have GOT to be angry they were fooled.

Bottom Line: Karma has a way of catching up with hateful people and hypocrites.

The NY Times said "As governor, Robert Bentley would quote the Bible before the Alabama Legislature and say that God had elevated him to the State Capitol. In the city where he was a Baptist deacon, he sometimes witnessed to patients." HIS WIFE found out he was having an Affair (because his love messages to his mistress showed up on her iPad). On Aug. 28, 2015, the governor’s wife filed for divorce.   Just READ this disgusting story (from several legit news sources):

Alabama "Conservative Family" Governor Resigns Over Sex Scandal With Top Aide

Story from Slate.com ; CNN, ABC News, etc. etc.
Alabama Gov. Robert Bentley managed to hold onto his job for a full year after the state capitol in Montgomery exploded with the news of his romantic relationship with a top aide, but, on Monday, April 10, with allies in the statehouse fleeing and serious criminal charges in the offing, the 74-year-old Republican surrendered—offering his resignation, pleading guilty to two misdemeanor crimes, and vowing never to hold public office again as part of a negotiated plea with the state’s attorney general’s office.

Bentley appears set to avoid jail time for crimes stemming from his attempts to conduct and conceal his apparent affair with Rebekah Mason, a former local TV anchor hired as his aide and 30-years his junior.  The Daily Beast reported:  According to the House committee’s report, Bentley would call Mason “baby” in meetings, and Ray Lewis, the leader of Bentley’s security detail, told the House committee that he had once observed Mason leaving the governor’s office with tousled hair, her outfit disheveled. The governor’s wife began taking screenshots of the governor’s texts with Mason that appeared on her iPad—conversations that eventually became crucial and cringeworthy evidence in the impeachment case against Bentley. The Washington Post reported:
March 23, 2016: A sexually explicit phone call between Bentley and a woman he calls “Rebekah” made its way to the media. The recording was made by his wife, Dianne Bentley!!

In addition, according to Alabama.com (Al.com): the [Alabama] Ethics Commission on Wednesday found enough evidence to believe Bentley had committed four felonies, including a violation of the ethics act and three violations of the Fair Campaign Practices Act.

Bentley’s resignation brings to a close the last chapter of his governorship that was full of tawdry twists and turns. After a full career as a doctor, Bentley didn’t hold public office until the age of 60. The former dermatologist won a seat in the statehouse in 2003 before running for governor in 2010.

This Week's Idiot in Politics: Kansas Senator Pat Roberts

All women should be appalled, especially those in Kansas. Sadly, there seems to be enough material for a weekly post of "Political idiot of the week" winners. Here's this week's winner from Kansas - a Republican Senator: Pat Roberts who made a snarky comment about mammograms and health coverage.

Reporter Alice Olstein of TalkingPoints Memo.com, a (legitimate) news source on Capitol Hill Tweeted: "I asked Sen. Roberts if he supports scrapping Essential Health Benefits. "I wouldn't want to lose my mammograms," he snarked"

Sen. Pat Roberts apologizes for 'mammogram' line

Story from CNN.COM:
Updated 2:54 PM ET, Thu March 23, 2017
(CNN)Sen. Pat Roberts, a Kansas Republican, apologized Thursday afternoon for making an apparent joke about mammograms related to what features are or are not included in Republicans' plan to repeal and replace Obamacare.
Kansas Republican Senator Pat Roberts Credit: CNN
"I deeply regret my comments on such an important topic," Roberts said in a statement. "I know several individuals whose lives have been saved by mammograms, and I recognize how essential they are to women's health. I never intended to indicate otherwise, and I apologize for my comments."
Roberts, who's known for employing a dry sense of humor, told a Talking Points Memo reporter earlier in the day: "I wouldn't want to lose my mammograms."
He was referring to a potential change in the Republican health care plan that would gut a measure requiring insurers to cover "essential health benefits," including mammograms for breast cancer screening.

This Week's Idiot in Politics: Oklahoma senator, faces child prostitution charges

This week's idiot in Politics is a Conservative Republican in Oklahoma who was found in a hotel room with a 17 year old boy he was paying for sex. Yes, he's married to a woman and has children.

Oklahoma GOP senator, faces child prostitution charges

OKLAHOMA CITY -- Oklahoma prosecutors on Thursday filed child prostitution charges against Republican state Sen. Ralph Shortey after police found him in a hotel room with a 17-year-old boy.
Shortey, 35, surrendered to authorities on charges of engaging in child prostitution, transporting a minor for prostitution and engaging in prostitution within 1,000 feet of church. His bond was set at $100,000.
“I have no comment at this time but I will soon,” Shortey told television reporters as he arrived at the Cleveland County jail to surrender.
Lt. Gov. Todd Lamb issued a statement calling on his fellow Republican to resign so that the people of his district can move forward with a new state senator.
Moore police said that acting on a tip from the teen’s father, officers went to the Super 8 Hotel last week and smelled marijuana coming from a room. They found Shortey and the teen alone inside.
A search of the teen’s tablet uncovered a series of sexually explicit exchanges in which Shortey referred to the teen as “baby boy” and offered him cash in exchange for “sexual stuff,” according to a police report. Police also found lotion and an open box of condoms inside backpacks in the room.
The age of consent in Oklahoma is 16, but Oklahoma’s prostitution statute applies to any person under 18 years old.
A conservative Republican from south Oklahoma City, Shortey is married with three young children.

The Oklahoma Senate imposed sanctions Wednesday on Shortey, voting 43-0 for a resolution that accuses him of “disorderly behavior.” Among other things, it removes Shortey from membership and leadership of various Senate committees, bars him from occupying his office and reserved parking spot at the Capitol, blocks his expense allowances and authorship of bills, and revokes his right to have an executive assistant.
Shortey, who was a county coordinator and early supporter of Donald Trump’s presidential campaign, wasn’t present when the resolution was adopted and didn’t show up to his Capitol office on Wednesday.

Idiots in Politics: Tennessee "Don't say gay" lawmaker’s torrid affair with his cousin revealed

Welcome to another blog edition of "Idiots in Politics" - this one is about a Tennessee anti-LGBTQ
lawmaker’s torrid affair with his cousin!

In a Divorce Trial, Serious Allegations About Sen. Joey Hensley
Hohenwald Republican is alleged to have had an affair with his nurse and prescribed her opioids
Mar 8, 2017 2 PM

The details sound straight out of a soap opera.
A doctor and his younger nurse fall in love. They continue their torrid affair even after his ex-wife tips off the nurse’s husband, a local politician, to the salacious goings-on. As the divorce moves forward, discovery turns up that the nurse is not just the doctor’s employee and his lover, but his patient, with a predilection for pain pills. And, oh, she’s his second cousin, too.
But this is not General Hospital, not Grey’s Anatomy. This is the town of Hohenwald (pop. 3,703) in Lewis County, where bitter divorce proceedings have brought to light possibly unethical behavior by Dr. Joey Hensley, a Republican state senator who also happens to be a family physician — and one who has run for office since 2002 on a platform of conservative Christian values.
Hensley, 61, was subpoenaed to appear last week in Williamson County Circuit Court to testify in the divorce proceedings of Hohenwald Vice Mayor Don Barber and his wife Lori. He refused to show up, citing legislative and medical privilege.
“I didn’t have time to do it,” Hensley said when contacted on Friday afternoon. “I had nothing to do with the court case, and any testimony I would have given wouldn’t have made any difference.”
But according to the sworn testimony of both Barbers, Hensley has been having an affair with Lori since 2014. Lori, 48, is a part-time nurse in Hensley’s medical practice in Lewis County; she is also his second cousin.
Hensley gained national notoriety in 2012 as a sponsor of the “Don’t Say Gay” bill, which would have banned public school teachers from even mentioning that homosexuality exists. During one hearing that year, Hensley commented, “I don’t think Modern Family is appropriate for children to watch” — because it features a married gay couple raising children. This session, Hensley is sponsoring a bill from the Tennessee Family Action Council that would make children created using donor sperm illegitimate — an attempt to make it harder for gay and lesbian parents to establish paternity. He is also a sponsor of the so-called “Milo Bill,” aimed at liberal practices on college campuses.
The subpoena ordered Hensley to bring evidence of any gifts or monies spent by him on Lori Barber or by her on him. Hensley declined to testify under a statute of Tennessee law that exempts “a member of the general assembly while in session” and also “a practicing physician” from subpoena to trial. But he will still be deposed about the affair, and that deposition will then be entered into the court record. The deposition has not been scheduled but is expected to occur in the next week or two.
According to testimony during the trial, Lori Barber started working for Hensley in 2013 part time as a licensed practical nurse in his practice, at a salary of $15 an hour. She still makes that same salary and currently works one day a week in his office. She had previously worked for Hensley from 1987 to 1988, prior to both her marriage and the completion of her nursing degree.
Barber testified she and Hensley began confiding in each other about problems in their marriages shortly after she took the job, but she said the relationship did not become sexual until December 2014, after the divorce became final between Hensley and his fourth wife, Gina, who is also a nurse. Their first sexual encounter was at Hensley’s practice, and soon, Barber said, the pair were discussing marriage.
This timeline is disputed by Don Barber. He found out about the affair in the spring of 2015, when Gina Hensley gave him a flash drive with evidence of her ex-husband’s affair, including recordings of phone calls and screenshots of sexually explicit text messages between Gina and Lori discussing Hensley’s sexual proclivities and detailing instances when he and Lori had sex. Court documents claim the files show that the affair began much earlier in 2014; proof of this was not shown in open court.
Around the same time that spring, Gina Hensley took out an order of protection from the senator, alleging he hit her with his car, twice. He denied it, and she eventually withdrew the claim. Sen. Hensley told Columbia’s Daily Herald at the time that Gina left him for another man, and he had “tried with all my heart to keep our family together.” He told the Scene something similar this week, saying, “I was devastated by my divorce.”
Lori Barber moved out in August 2015 and filed for divorce later that fall. She testified that she ended her affair with Hensley in April 2016, but that things started up again in June. She said the couple continue to discuss marriage as a future possibility. (It is legal in Tennessee for second cousins of any age to marry.)
Barber also testified that she spent the nights of Feb. 8 and and Feb. 14 this year with Hensley at a hotel in downtown Nashville while he was in town for legislative duties. Although those nights were presumably paid with a legislative per diem — i.e., state dollars — Legislative Administration director Connie Ridley said whether or not someone else stays with a legislator if he or she is in town on legitimate business “is not pertinent to the payment,” per state law.
Hensley denied that he is still romantically involved with Barber.
“No, I’m divorced, I don’t know what she’s talking about,” Hensley said when asked if they were still discussing marriage. He also denied that Barber had spent either night in February in his hotel room. When asked if this is what he would testify to under oath during his deposition, Hensley said he had no further comment.
In a second conversation three days later, Hensley said the affair lasted only “a few months.”
“It’s not still ongoing,” Hensley said Monday night. “That was several months ago, years ago. I didn’t break any laws. I’m not married, I’m divorced. … And nothing happened while I was married. … She didn’t leave because of me, it wasn’t because of me. We’ve been friends for 30 years or more. She’s related to me, but she’s been a friend too.”
But Lori Barber is not just a friend or a cousin or a lover — she is also Hensley’s patient. Barber testified in court that Hensley is her only doctor other than a cardiologist, and that she relies on him for recurrent Botox injections. She also said he has regularly prescribed her the hydrocodone-acetaminophen pill Lortab — a Schedule II controlled substance — for “chronic back pain,” which she said Hensley first diagnosed after she hurt her neck.
Court testimony and documents filed imply that Barber has possibly abused both alcohol and opioids; she testified that she has no problem with either and any uptick in consumption was due to the stress of the divorce. But in her deposition, Barber was asked by her husband’s lawyer, Rose Palermo, “And didn’t your parents come to you and say that this situation with the Lortab had to be reined in, because you were taking too many Lortabs?” Barber replied, “I was taking too many according to them, but I was taking exactly what I was prescribed.” Palermo followed up, “By Dr. Hensley?” Barber answered, “Yes.”
When asked last week if he often provides his nurses with opioid prescriptions, Hensley said he treats all his patients “the same” and declined further comment. On Monday, when asked if it concerned him that a nurse in his employ had been somewhat frequently taking hydrocodone, Hensley replied, “She’s a patient of mine, and anything I treat a patient with is [protected by] HIPAA.” She’s a patient, but she’s also an employee, the Scene said. “Well, it’s a small town. People don’t have an option for some things,” Hensley said.
It is a clear violation of the American Medical Association’s code of ethics — to which the Tennessee Board of Medical Examiners subscribes — for a doctor to become romantically involved with a patient. It is also in violation of the state board’s guidelines to regularly treat immediate family members or prescribe them drugs. The policy states, in part, “Treatment of immediate family members should be reserved only for minor illnesses or emergency situations. … No schedule II, III or IV controlled substances should be dispensed or prescribed except in emergency situations.” But there are no AMA or state guidelines that specifically prohibit doctors from treating employees.
Yet an examination of recent disciplinary actions by the Board of Medical Examiners suggests Hensley’s actions with Barber could certainly border on the unethical. In the past year, from January 2016 to January 2017 (the latest month for which data was available), the board has taken action against at least 13 doctors for, in part, prescribing controlled substances to an employee, a family member or a patient with whom the doctor was in a romantic relationship. The actions ranged from a reprimand to license revocation or forced retirement, with an additional wide range of fines.
It’s important to note that no action was taken solely based on one instance of prescribing drugs to a family member or employee alone — all of the instances above include multiple and varied violations of state rules and regulations. And Hensley said his treatment of Barber is in no way a violation of the code of ethics, because he regularly treats a lot of family members.
“I’ve been practicing 30 years,” says Hensley. “I have thousands of patients. It’s a small town, and I have a lot of family. A lot of family. Cousins, uncles, aunts. … And I don’t treat anyone any different.”
